Welcome to The Coffee Club (the “Website”, “Service”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at [www.yourcoffeebrand.com], our mobile applications (if any), and any related services, including the purchase of coffee subscriptions, one-time coffee orders, merchandise, and membership plans (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services and make purchases. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Accounts
Some features of the Services (including subscriptions and memberships) require you to create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain the security of your password
Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts for any violation of these Terms.
3. Subscriptions & Recurring Payments
3.1 Subscription Plans
We offer various coffee subscription plans with different frequencies (e.g., weekly, bi-weekly, monthly). By purchasing a subscription, you authorize us (and our third-party payment processor) to charge your chosen payment method on a recurring basis according to the frequency and price selected at the time of purchase.
3.2 Auto-Renewal & Cancellation
Subscriptions automatically renew at the end of each billing cycle unless you cancel. You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for the current period.
3.3 Price & Frequency Changes
We may modify subscription prices, shipping fees, or delivery frequency with notice (via email or on the Website). Continued use of the subscription after such changes constitutes acceptance of the new terms.
3.4 Payment Failures
If a payment fails, we may retry the charge several times. If payment remains unsuccessful, we may suspend or cancel your subscription.
4. Membership Plans
We offer paid membership programs that provide benefits such as discounts on coffee and/or merchandise, free shipping thresholds, early access to new products, or other perks (“Membership”).
Memberships are billed monthly or annually (as chosen) and auto-renew.
Benefits are subject to change with notice.
Memberships are non-transferable.
Cancellation follows the same rules as subscriptions above.
5. Orders, Payment & Shipping
5.1 Pricing & Taxes
All prices are listed in USD and exclude applicable sales tax, shipping, and handling fees unless otherwise stated. We reserve the right to correct any pricing errors.
5.2 Payment
We accept major credit/debit cards and other payment methods we may offer. By providing payment information, you represent that you are authorized to use that method.
5.3 Shipping & Delivery
Delivery times are estimates only. We are not responsible for delays caused by carriers, weather, customs (for international orders), or other events beyond our reasonable control. Title and risk of loss pass to you upon delivery to the carrier.
5.4 Returns & Refunds
Perishable coffee products: Due to food safety regulations, opened or used coffee bags generally cannot be returned or refunded.
Unopened coffee / merchandise: Returns accepted within 30 days of delivery for a refund or exchange (subject to our Return Policy).
Membership fees: Non-refundable except where required by law.
6. Intellectual Property
All content on the Website (text, graphics, logos, images, product photos, designs) is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
7. User Content
If you submit reviews, photos, comments, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any form.
You represent that your User Content does not violate any third-party rights.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
WE PROVIDE THE SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. Termination
We may suspend or terminate your access to the Services at any time, without notice, for conduct we believe violates these Terms or is harmful to other users or to us.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Howard County, Indiana. You consent to the personal jurisdiction of such courts.
12. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date indicates when changes were last made. Continued use of the Services after any changes constitutes acceptance of the updated Terms.
